These Terms of Use ("Terms") are a binding agreement between Rent Curves Inc, a Kansas corporation ("Rent Curves," "we," "us," or "our"), and you ("you" or "User"), governing your access to and use of the Rent Curves website, application, and rent-calculation tools (collectively, the "Service"). By creating an account, purchasing Credits, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms should be read together with our Privacy Policy, which describes how we collect and use information and is incorporated by reference.

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for use by individuals and entities involved in agricultural land rental arrangements — including farm operators/tenants ("Farmers") and landowners/lessors ("Landowners") — for business and agricultural purposes, and is not directed to children.
By using the Service, you represent that you meet these requirements and that all information you provide to us is accurate and complete.
Rent Curves provides software that calculates proposed or final agricultural land rental rates ("Rent Curves," "rent curves," or "calculations") using data supplied by the User, including yield, price, cost of production, government program payments, insurance premiums, average yield, and highest yield, across a range of possible outcomes from zero yield to the highest yield entered.
The Service is a calculation and decision-support tool only. Rent Curves is not a party to, and does not create, review, approve, negotiate, or enforce, any lease, rental agreement, or other contract between a Farmer and a Landowner. Any agreement reached using output from the Service is solely between the Farmer and Landowner involved, and Rent Curves has no obligation or liability with respect to that agreement.
Both Farmers and Landowners may register for accounts. A single Farmer may work with multiple Landowners, and a single Landowner may work with multiple Farmers; either party may maintain more than one account or field relationship as needed for their business.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at legal@rentcurves.com of any unauthorized use of your account.
In many transactions, one party to a rental arrangement (a Farmer or a Landowner) may not create a Rent Curves account. In that case, the registered User may generate, share, or email the proposed or final rent curve and underlying calculation — including pre-harvest or post-harvest yield, price, and cost figures — to that non-user counterparty outside the Service.
If you share a calculation, report, or other output with a non-user counterparty, you are solely responsible for the accuracy, appropriateness, and confidentiality of that disclosure, and for obtaining any consent that counterparty's involvement may require. See also Section 1.2 (Information About Others) and Section 8.4 (Individuals Without an Account) of our Privacy Policy.
Access to certain features of the Service is sold as "Credits." One (1) Credit permits one-time use of the calculation tool for a single field and a single crop. You may purchase Credits in the quantities offered through the Service (for example, a Farmer working across several fields and Landowners may purchase 2, 100, or another number of Credits as needed).
All payments are processed through a third-party payment processor (such as Stripe). Rent Curves does not store your full payment card number. You authorize us and our payment processor to charge your chosen payment method for all Credits and fees you purchase. You are responsible for all applicable taxes.
Subject to your compliance with these Terms, Rent Curves grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal agricultural business purposes.

You retain ownership of the farm, field, crop, financial, and counterparty data you submit to the Service ("User Data"). You grant Rent Curves a worldwide, royalty-free license to host, process, reproduce, and use User Data solely to provide, maintain, support, and improve the Service, and as otherwise described in our Privacy Policy.
You represent that you have the right to submit any information about a third party (such as a Landowner's or Farmer's name, contact information, or field/financial data) that you provide through the Service, and that you have provided any notice to that individual required by applicable law.
Rent Curves may use de-identified or aggregated data (which does not identify you or any individual) for analytics, benchmarking, research, and to improve our products and services.
The Service, including its software, calculation methodology, design, text, graphics, and all related intellectual property, is owned by Rent Curves Inc or its licensors and is protected by copyright, trademark, trade secret, and other laws. Except for the limited license granted in Section 5, no rights are granted to you in the Service, and all rights not expressly granted are reserved by Rent Curves.
THE SERVICE, INCLUDING ALL CALCULATIONS, ESTIMATES, AND OUTPUT, IS PROVIDED FOR INFORMATIONAL AND DECISION-SUPPORT PURPOSES ONLY. IT IS NOT LEGAL, TAX, ACCOUNTING, AGRONOMIC, OR FINANCIAL ADVICE, AND IS NOT A GUARANTEE, APPRAISAL, OR WARRANTY OF ANY PARTICULAR RENTAL RATE, YIELD, PRICE, COST, OR OUTCOME. YOU SHOULD INDEPENDENTLY EVALUATE, AND WHERE APPROPRIATE CONSULT YOUR OWN ADVISORS ABOUT, ANY RENTAL ARRANGEMENT BEFORE ENTERING INTO IT.
The inputs you provide — including Yield, Price, Cost of Production, government payments, Insurance Premiums, Average Yield, and Highest Yield — all affect the resulting rent calculation across the full yield range from zero to the Highest Yield entered. Because the calculation depends entirely on the accuracy and completeness of the inputs provided by you or the other party to the arrangement, Rent Curves Inc is not responsible for any perceived incorrect rent, or for any effect on the profitability of either the farm operator (rent payor) or the landowner (rent receiver), resulting from use of the Service or reliance on its calculations.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, RENT CURVES INC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, RENTAL INCOME, OR CROP VALUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY RENTAL ARRANGEMENT ENTERED BASED ON ITS OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, RENT CURVES' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO RENT CURVES FOR CREDITS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Rent Curves Inc and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) any rental arrangement, dispute, or communication between you and a Farmer, Landowner, or other counterparty; or (d) your submission of information about a third party without the right to do so.
The Service uses third-party providers to operate, including a payment processor (such as Stripe) to handle billing, an analytics provider (such as Google Analytics) to understand usage of the Service, and an email or messaging provider to send account, transactional, and marketing communications. These providers process data on our behalf as described in our Privacy Policy, and your use of the Service is also subject to those providers' applicable terms.
These Terms remain in effect while you use the Service. You may stop using the Service and close your account at any time; unused Credits are handled as described in Section 4. We may suspend or terminate your access to the Service if you violate these Terms, pose a risk to the Service or other users, or as required by law. Sections that by their nature should survive termination (including Sections 6–10 and 13–17) will survive.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
You and Rent Curves agree to first try to resolve any dispute informally by contacting legal@rentcurves.com. If a dispute is not resolved within 30 days, you and Rent Curves agree that it will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
YOU AND RENT CURVES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@rentcurves.com with your name and account email and a clear statement that you wish to opt out of arbitration. If you opt out, this Section 13 will not apply to you, but the rest of these Terms will.
These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws principles, except to the extent governed by the Federal Arbitration Act as to Section 13. For any claim not subject to arbitration (including small claims actions or as otherwise permitted above), the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Kansas.
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by posting an updated "Last Updated" date, by email, or through the Service). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
